Terms

These are the standard Terms of Service for any Website Setup, Design and Hosting on the Story Tappy network, as offered by Reading Insights Pty Ltd. The Customer agrees to these Terms before commencing any services offered by Reading Insights Pty Ltd operating as Story Tappy.

Section A – General:

  1. It is the responsibility of the Customer to keep Story Tappy up-to-date on any changes in their contact details.
  2. Customers are prohibited from selling or reselling their website on the Story Tappy network to third parties.
  3. Story Tappy reserves the right to refuse its services to anyone. This includes the right to suspend or cancel a Customer’s access to existing services.
  4. Story Tappy reserves one hour per week for site maintenance, during which time, site owners (Customers) are advised not to make changes to their website. The maintenance timeframe will be noted on the Story Tappy Resources > Tips page.

Section B – Fees, Suspensions and Cancellations:

  1. Set-up and subscription (host) fees are charged on a pre-pay (not post-pay) basis and are non-refundable.
  2. Any additional fees (design or support) will be negotiated separately, including payment schedule.
  3. All prices are listed in Australian dollars (AUD).
  4. The Customer can cancel their subscription at any time. There will be no pro-rata refund for the remainder of that billing cycle (month). Please contact Story Tappy for service cancellations.
  5. While the Customer can cancel their subscription, they cannot suspend it; however, Story Tappy can unlink the custom domain if requested so that it is not visible to the public. The Customer can also add password protection to any page on their website if they wish.
  6. A lapse in payment will result in the ‘unlinking’ of domain from the Customer’s website (rendering it non-usable). To ‘relink’ the domain, a connection fee of $50 is required.
  7. Subsequent payment failure will result in the deletion of the website. Story Tappy is not obligated to save or provide a copy of the deleted content. Story Tappy will not be responsible for any lost data or income as a result of a deleted site. If the Customer wishes to cancel their host subscription, they should contact Story Tappy and copy desired content to their computer before deletion.
  8. Story Tappy may change its fees at any time but will provide the Customer with two months’ written notice via email.
  9. Any limitations by Story Tappy’s third party services (including, but not limited, to the server, content delivery network, plugins or themes) do not warrant sufficient reason for the Customer to withhold payment of their subscription. 

Section C – Design, Content & Support:

  1. The Customer will receive a website that is ready for them to customise with content. The timeline for this will depend on (a) when relevant information is provided by the Customer to Story Tappy, and (b) whether there are additional design services agreed to in writing by the Customer, beyond the standard Setup service described below. The initial Setup fee and first month’s host fee provide time for the setup and delivery of the website. 
  2. As part of the standard Setup service, Story Tappy offers to:
    • Create the Customer’s nominated pages – based on Customer information. (Story Tappy does not create the content on those pages.)
    • Specify the home page – based on Customer information.
    • Specify the blog page – based on Customer information.
    • Create a basic menu hierarchy – based on Customer information.
    • Add a site title and description (tag line) – based on Customer information.
    • Add a favicon (image for browser tabs) and logo – based on Customer information. (Story Tappy does not create these images; only adds them to the site.)
    • Install a site-wide Astra template – based on Customer information. The Customer does not hold copyright of this templated design.
    • Link the website to the Customer’s domain, provided that the Customer provides Story Tappy with relevant access to the domain provider. If a domain is not supplied by the Customer, Story Tappy will provide a subdomain in its place.
    • Optionally provide the Customer with the embed-link of two Lottie animations of the Customer’s choice – to be optionally used on their website hosted by Story Tappy. The Customer does not hold copyright of these animations.
    • Story Tappy is not obligated to provide any of the above setup services if the Customer does not provide relevant information prior to commencement of the setup process. The Customer is strongly advised to email all relevant information and files to Story Tappy prior to making payment for the setup service.
    • Once Story Tappy provides dashboard access to the Customer, this signifies the completion of the setup process. Story Tappy is not obligated to provide any of the above services after the Customer has been given dashboard access, even if some services could not be fulfilled prior to handover due to lack of information from the Customer.
  3. Website design remains the property of Story Tappy while on the Story Tappy network. The Customer can recreate the same web design on another network, where it would not be the property of Story Tappy. However, that does not mean the Customer can claim exclusive rights to the design (logo excepted).
  4. The Customer cannot recreate other people’s sites on the Story Tappy network (infringing on copyright and risking fraud).
  5. The content of the website (informational) is owned by the Customer, not Story Tappy.
  6. Story Tappy’s WordPress websites are self-managed and Story Tappy is not responsible for any copy, editing or updates on website content. Story Tappy is under no obligation to do any work on the Customer’s website unless otherwise contracted to do so.
  7. Customers are responsible for making back-ups of their own pages and templates. Story Tappy does not offer a back-up service for individual sites. Advice about how to make back-ups is offered on the Story Tappy Resources > Tips page.
  8. Advice on how to use Story Tappy’s design tools is provided on its Resources site. Story Tappy is not obligated to assist in the Customer’s web design capability. If assistance is needed, Story Tappy will quote separately from its web hosting service. In particular, Customers should be made aware that the Elementor page builder is separate from the default WordPress page builder and that shifting between the two page builders can result in page errors. Information such as this is clearly noted in the Story Tappy Resources > Tips section. It is for the Customer to learn how to use the tools provided by third party plugins and themes, and not for Story Tappy to counsel the Customer on troubleshooting matters.
  9. Not all widgets will be compatible with one another on a page, as explained on the Resources > Tips page. Such situations will only be apparent through trial-and-error. By and large, all widgets function without issue. The ones that are most likely to experience conflict with other widgets are scrolling tools. Suffice to say, Story Tappy does not guarantee that all widgets will function as advertised by any third party plugin authors such as Premium Addons for Elementor.
  10. Comments are disabled on the website. 
  11. Each website is allocated a maximum amount of bandwidth (100GB) and disk space (500MB) per month. The disk space cannot be surpassed without authorisation by Story Tappy. Any additional bandwidth will incur a penalty charge or (if the penalty is not acceptable) a warning that the website will be cancelled from the Story Tappy network if the usage exceeds its allowance again. No further notice then needs to be given prior to web hosting cancellation and Story Tappy will be under no obligation to recreate the Customer’s website with a different host. If the Customer seeks ongoing additional bandwidth or disk space, Story Tappy can quote on a different host fee. In that case, Story Tappy will cancel the current subscription to offer a new one. The same Terms of Service will apply.  
  12. Story Tappy does not take responsibility for any website going offline due to exceeding bandwidth or disk space.
  13. Story Tappy does not take responsibility for any website going offline due to limitations by its service providers (including the server, content delivery network, plugins and themes). However, if an issue arises from a fault by the third party service, Story Tappy will endeavour to apply relevant updates and fixes, as provided by the third party.
  14. Story Tappy websites are expected to function on updated web browsers; not browsers that have not been updated within 12 months.
  15. Story Tappy does not offer eCommerce solutions on its website unless specifically agreed to with the Customer in writing, separate to this agreement. As default, the Customer can still make sales via Paypal and Stripe on their website but it is for the Customer to set up that payment gateway on their website, not Story Tappy.
  16. Story Tappy is in no way liable for any money or loss of potential money via the Customer’s website, whether the claim is made by the Customer or a third party who has interacted through the Customer’s website.
  17. Story Tappy does not offer form functionality on its network, such as contact forms. Although a form widget is included within the WordPress and Elementor page builders, Story Tappy states from the outset that it does not guarantee any form functionality despite this. Story Tappy instead recommends that the Customer either state their contact details and/or embed forms from third parties such as MailChimp and Google Forms. Story Tappy is not responsible for the Customer’s site integration with third party data collection services such as MailChimp and Google Forms.
  18. There is a link to the Story Tappy website in the footer of the Customer’s website. This footer link cannot be removed while the site is hosted on the Story Tappy network. 
  19. Analytics is possible on the Customer’s site via Site Kit. It is the Customer’s responsibility to activate their Site Kit account on their website. Story Tappy is not obligated to assist in the connection between the Customer’s website and Site Kit’s service.
  20. Story Tappy does not allow the following content on websites on its network. If such content is present, Story Tappy can immediately cancel the website, with no obligation to reinstate it or retrieve or transfer content to the Customer.
    • Nudity and adult content
    • Defamatory content
    • Illegal content.
  21. Story Tappy is not liable for any copyright breaches of content on the Customer’s website.
  22. Design services, such as for images, animations, or sections, are separate to Story Tappy’s setup and host services. Design services must be agreed to in writing (via email) prior to commencement, including payment terms. Unless specified in such agreements, Story Tappy does not claim to hold copyright on any of the designs provided to the Customer. As such, the Customer should specify their copyright requirements during the negotiation process, particularly if the design is for a logo (unique design). Otherwise, some of the elements within a design may be sourced from third parties, such as Lottie Files or Vecteezy. These designs may not be exclusive and may not include transferable copyright. Story Tappy can create original designs if requested. Original designs would become the property of the Customer once payment has been made.

Section D – Domain Registration:

  1. The Customer is responsible for the choice and purchase of a custom domain. In lieu of a custom domain, Story Tappy will provide a free subdomain.
  2. Story Tappy is in no way liable for the requirements of domain names, including registration, legal requirements, renewal and/or transfer.

Section E – Limitations of Liability:

Story Tappy is not liable to the Customer under the following stipulations:

  1. There is no express guarantee from any party, affiliate, agent, merchants or licensers that any Story Tappy’s services will not be interrupted or error-free.
  2. There is no express guarantee of the reliability of any information or service contained in, or provided through, the servers used by Story Tappy.
  3. Story Tappy is not responsible for any damage to the Customer’s computer systems, nor the loss of any data as a result of download, use or further distribution of any material – digital or otherwise – from websites on the Story Tappy network, nor from any of its active Customers.
  4. Story Tappy is not liable for any direct, indirect, incidental, negligent, special or consequential damage resulting from the use or inability of use of its services – nor from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission or any failure of performance, whether or not due to communication failure, theft, destruction or unauthorised access to Story Tappy records, programs, servers or services.
  5. Story Tappy and its director(s), shareholder(s), employee(s) and agent(s) shall not be liable, under any circumstances, for any loss of business, profits, goodwill, data, interruption of service, or for any indirect, special, incidental or consequential damages of any character.

Section F – Indemnification:

The Customer agrees that it shall defend, indemnify, save and hold Story Tappy harmless from any and all demands, liabilities, losses, costs and claims, including attorneys’ fees, asserted against Story Tappy, its agents, customers, owners and employees, that may arise or result from any service provided or agreed to be provided or any product sold by the Customer, its agents, or employees.

The Customer agrees to defend, indemnify and hold harmless Story Tappy against Liabilities arising out of:

  1. any injury to person or property caused by any products sold or otherwise distributed in connection with the Story Tappy network
  2. any material supplied by the Customer infringing or allegedly infringing on the proprietary rights of a third party
  3. copyright infringement
  4. any defective product which the Customer sold via the Story Tappy network.

Section G – Goodwill:

Story Tappy’s Terms assumes goodwill from both sides (Customer and Story Tappy) re:

  1. what can reasonably be achieved in a given time frame
  2. the best use of resources to achieve the most effective outcomes

Section H – Contract Revisions:

Revisions to this Contract will be applicable to previous Contracts. Revisions will be considered agreed to by the Customer on continuation of Story Tappy’s web hosting service, as paid monthly in advance.
